Kenneth R. Meyer, a product liability defense practitioner, has joined McCarter & English as a partner after 28 years at Porzio, Bromberg & Newman. His 28 years at Porzio included 16 years as chair of the product liability and then life sciences practice groups.
Mr. Meyer, who is admitted to practice in New Jersey, New York and Texas, will be resident in McCarter & English’s Newark office. He defends manufacturers from a variety of industry sectors, including pharmaceutical and manufacturing, in product liability cases. He also writes warnings for product labels, prepares product owners’ manuals and assists manufacturers with product liability risk-prevention. Mr. Meyer is a Certified Civil Trial Attorney (certification by the New Jersey Supreme Court). He particularly enjoys mentoring younger trial lawyers on advocacy skills, and lists the week he taught at the International Association of Defense Counsel Trial Academy at Stanford University as a career highlight.
His experience extends to a wide range of products including pharmaceuticals, vaccines and medical devices; golf carts, industrial machinery, construction equipment, cranes, lift trucks and automobiles; and asbestos and chemicals. He counsels clients in product risk avoidance and has assisted with product recalls. Mr. Meyer has also drafted warning labels for products such as pharmaceuticals, mounted sport cameras, beer kegs, cosmetics and heating devices, and has written or edited instruction manuals for products including bicycles and electronic transformer systems. He has extensive appellate experience, primarily in product liability cases in New York and New Jersey. Mr. Meyer successfully tried and handled the appeal in Congiusti v. Ingersoll-Rand, the case in which the New Jersey Appellate Courts adopted the alternate safer design theory of The Restatement of Law Third, Torts: Product Liability.
