A serious loss or breach of a company’s data will cause a business interruption and loss of trust in the marketplace.  Class actions, shareholder derivative suits and regulatory scrutiny from the FTC, state attorneys general and others may also follow.  Sony’s recent hack is expected to cost the company about $100 million, a sum not likely to be made up by online streaming revenue from “The Interview”.  President Obama is proposing a national data breach response statute, but it is not clear how workable or preemptive it will be.  In-house counsel need to be conversant with data privacy and breach laws and have a data breach response plan.  The Data Privacy and Security group at Lathrop & Gage will provide you with the state of the law on data breach, and practical advice on how to mitigate and manage the risks associated with data.
