Government enforcers and plaintiffs' attorneys have turned their attention to the financial services industry in an unprecedented way. Antitrust is no exception to this rule, as demonstrated by major cases such as municipal bonds, municipal tax liens, foreclosure auctions, and LIBOR. But is antitrust enforcement a good match for policing the financial services industry? There have been some suggestions that the tools typically used by antitrust enforcers must be modified when applied to financial services firms.
