Through recent decisions, NLRB  has expanded its effective role into regulation of many areas that we formerly considered “employment law.” In some of these areas, such as social media usage by employees, the Board is one of the first regulatory authorities to take on a comprehensive role in regulation. Because, for the first time in a decade, the National Labor Relations Board now has a full complement of members confirmed by the Senate, the Board’s role in such regulation is more important than ever. Mr. Johnson will discuss this phenomenon, recount some of the specific issues currently pending before the Board in these areas, such as social media, handbook regulation, arbitration agreements, and employee email.
