This presentation will cover independent contractor misclassification and joint employment issues.   We will discuss the many different tests for determining if a worker is properly classified as an independent contractor, best practices and practical tips for avoiding liability, and the wide-ranging implications of misclassification, including severe penalties under the newly enacted Labor Code section 226.8.  We will also discuss joint employment theories, such as when a worker seeks to hold multiple entities liable as his or her employer or uses the joint employer theory to expand the scope of a class action to include workers at several related entities.
