This course will explore the considerations and strategies employed by assignees and defense counsel affected by the holding in Sherwood Partners, Inc. v. Lycos, Inc, 394 F.3d 1198 (9th Cir. 2005) that CCP § 1800 state law preference actions brought by an assignee are preempted by the Bankruptcy Code, and the converse holding in Haberbush v. Charles & Dorothy Cummins Family Ltd. P’ship, 139 Cal. App. 4th 1630 (2006) that CCP § 1800 is not preempted.
