This course provides a practical introduction to patent infringement litigation – from pre-filing investigation through appeal-identifying themes to help breath life into a trial strategy. Topics will cover pre-filing investigation; joinder of parties and claims; discovery and e-discovery; Markman claim construction motions; and appeal.

Patrick Coyne, Finnegan, Henderson, Farabow, Garret & Dunner, LLP will address claim construction, direct and indirect infringement, equivalents, validity, enforceability, counterclaims, remedies, and settlement and negotiation strategies. The interplay between civil trial strategy and the many new procedures under the America Invents Act will also be discussed. The course is ideal for both trial attorneys with general civil litigation background and patent attorneys.
