A panel of experienced prosecutors and defense counsel will review and discuss ethical and tactical issues that arise in antitrust investigations. The course will also address the following antitrust concerns: false statements, obstruction and similar issues arising with companies and witnesses in criminal antitrust investigations; lessons learned from recent corporate misconduct prosecutions; ethical issues raised by the existence of the government’s amnesty and amnesty plus programs for companies and individuals; conflicts of interest and multiple representation issues; ethical issues raised by participation in and withdrawal from joint defense arrangements in both criminal and civil investigations; and counseling clients on taking the risk in criminal investigations and the ethical issues highlighted by such tactical decisions.
