In a discussion moderated by John S. Worden, Schiff Hardin LLP and chair of the bar’s Arbitration Committee, a panel will discuss the effects of a Supreme Court ruling last April that the Federal Arbitration Act preempts state laws that prohibit contracts from disallowing class action lawsuits. By permitting contracts that exclude class action arbitration, the high court’s decision will make it much harder for consumers to file class action lawsuits. The lawyers who handled the case and oppose its result will debate the following: how the decision has shaken out so far; things the plaintiffs’ bar is doing to adjust and adapt to the ruling; what must still be found out on the California and federal levels; the chances of legislative or executive intervention; and how the defense bar views the future.
