WMACCA Schedules Employment And Labor Forum In Washington, DC

Thursday, September 1, 2011 - 00:00

The Washington Metro Area Association of Corporate Counsel will present a Litigation and Employment Labor Forum: When You Can Never Say Goodbye to Former Employees.

It begins at noon and ends at 2:00 p.m. on Wednesday, September 14, at the offices of Akin Gump Strauss Hauer & Feld LLP, 1333 New Hampshire Avenue, N.W., in Washington, DC. The speakers will present various scenarios in which a company is being sued in an eight-figure lawsuit challenging the legality of certain key business practices. The panel will use the example of how to best deal with individuals who are key to attendees' ability to defend against the charges in the most practical ways. For example, are practitioners allowed to contact them and have privileged conversations? Will these key people communicate, and if they do cooperate, must counsel pay them? Should counsel provide them with separate counsel? Can an adversary contact them? This program will explore these and other issues arising when litigation implicates former employees.

The forum will focus not only on what counsel should do once the lawsuit is filed, but also on what to do beforehand, such as employment and severance agreements to promote cooperation with departed employees and to safeguard the company's confidential and proprietary information. The subjects are also a critical part of corporate counsel's practice, as in-house counsel are usually asked to be the key liaison between the former employee and the company and outside counsel.

The program will be presented by Larry E. Tanenbaum of Akin Gump Strauss Hauer & Feld LLP and in-house panelists.
